This spring, students in the University of Calgary’s Law 696:
Constitutional Clinical completed a review of the constitutionality of
Alberta’s exclusion of farm workers from most statutory employment law, mooting
potential Charter challenge angles.
Aside from being a wonderful way to teach constitutional
law, the results are fairly compelling. You can read them in the following
posts on Ablawg.ca
Overall, these posts identify one pathway that advocates of basic employment rights for farm workers can follow, given that the government
has proven reluctant to make good on its promise to provide these basic protections.
The real question is whether there are any groups with deep enough pockets to
fund such a challenge.
